Terms of Service

These Terms of Service ("Terms") govern your access to and use of ScamCatchers (the "Service"), operated by Rolenya LLC ("Company," "we," "us," or "our"). By accessing or using ScamCatchers, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

ScamCatchers is an informational tool that aggregates publicly available data from multiple sources to help users assess potential fraud risk associated with phone numbers, names, businesses, websites, and other identifiers. The Service uses artificial intelligence to analyze and summarize data from public records, government databases, community reports, and other third-party sources.

IMPORTANT: ScamCatchers is NOT a consumer reporting agency as defined by the Fair Credit Reporting Act ("FCRA"), 15 U.S.C. § 1681 et seq. The Service does not provide "consumer reports" as defined by the FCRA. You may not use ScamCatchers for any purpose covered by the FCRA, including but not limited to: employment screening, tenant screening, credit decisions, insurance underwriting, or any other purpose that would require FCRA compliance.

2. Eligibility

You must be at least 18 years old to use ScamCatchers. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.

3. Account Registration and Subscriptions

Certain features of ScamCatchers require a paid subscription. Subscriptions are processed through Stripe, Inc. ("Stripe"), a third-party payment processor. By purchasing a subscription, you agree to Stripe's terms of service in addition to these Terms.

Billing: Subscriptions are billed on a recurring basis (monthly or annually, depending on the plan selected). You authorize us to charge your payment method on file for each billing cycle.

Cancellation: You may cancel your subscription at any time through the Manage Subscription section of the Service. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of your paid period.

Refunds: Due to the nature of digital information services, all sales are final. We do not offer refunds for partial billing periods or unused searches. If you believe you were charged in error, contact us at support@scamcatchers.com within 30 days of the charge.

Free Tier: We may offer limited free searches. We reserve the right to modify, limit, or discontinue the free tier at any time without notice.

4. Acceptable Use

You agree to use ScamCatchers only for lawful purposes and in accordance with these Terms. You agree NOT to:

(a) Use the Service for any purpose prohibited by the FCRA, including employment screening, tenant screening, credit eligibility, or insurance underwriting;

(c) Use the Service to discriminate against any person on the basis of race, color, religion, sex, national origin, disability, or any other protected characteristic;

(e) Attempt to reverse-engineer, decompile, or extract the source code of the Service;

(f) Resell, redistribute, or commercially exploit the results obtained from the Service;

(h) Circumvent, disable, or interfere with any security or access-control features of the Service;

(i) Use the Service in any manner that could damage, disable, overburden, or impair our servers or networks.

5. Accuracy and Limitations of Data

ScamCatchers aggregates data from third-party sources, public records, and community-submitted reports. We do NOT guarantee the accuracy, completeness, reliability, or timeliness of any information provided through the Service.

AI-generated analysis, risk scores, and verdicts are informational estimates only and should not be treated as definitive conclusions. Results may contain errors, outdated information, or false positives/negatives.

(a) A "SAFE" verdict does not guarantee that a person, business, or phone number is legitimate;

(b) A "HIGH_RISK" or "SUSPICIOUS" verdict does not definitively prove fraud or criminal activity;

(d) You should use the information provided as one factor among many in your own decision-making process.

6. User-Submitted Content

By submitting a scam report or other content to ScamCatchers, you grant Rolenya LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, and distribute such content in connection with the Service. You represent and warrant that any content you submit is truthful and accurate to the best of your knowledge, and that you have the right to submit such content.

You are solely responsible for the content you submit. Submitting knowingly false reports may result in termination of your account and may expose you to legal liability.

7. Intellectual Property

The Service, including its design, logo, software, and original content, is the property of Rolenya LLC and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works based on the Service without our prior written consent.

If you believe that content on ScamCatchers infringes your copyright or other rights, or if you believe information about you is inaccurate and wish to request its removal, please contact us at legal@scamcatchers.com with the following information:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.

We do not warrant that: (a) the Service will be uninterrupted, secure, or error-free; (b) the results obtained from the Service will be accurate or reliable; (c) any defects in the Service will be corrected; or (d) the Service will meet your expectations or requirements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ROLENYA LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rolenya LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content you submit to the Service.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State in which Rolenya LLC is organized, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted in the state in which Rolenya LLC is organized.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service will immediately cease. Sections 5, 9, 10, 11, and 12 shall survive termination.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
